Niagara Cooler Inc. Heat Warranty
Niagara Cooler Inc. warrants to the customer of each new heat exchanger that it will repair or replace without charge any part of the heat exchanger that fails during the warranty period where such failure results from a defect in workmanship or materials. This warranty is conditioned upon the part claimed to be defective being delivered or made available to Niagara Cooler Inc. and its examination verifying the claimed defect. The warranty period shall be - twelve - (12) months from date of delivery.
This warranty does not cover and NCI shall have no responsibility for:
- conditions which, in the reasonable judgment of NCI, arise from misuse, overloading, negligence, alteration, accident or lack of performance of necessary maintenance services.
- diagnostic, removal or re-installation labor charges.
- freight charges for either defective parts or new or repaired parts unless prior written approval is obtained from NCI or:
- claims for loss of time, inconvenience, loss of use or other consequential damages.
THIS WARRANTY IS EXPRESSLY IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND OF ANY NON-CONTRACTUAL LIABILITIES INCLUDING LIABILITIES FOR PERSONAL INJURY OR PROPERTY DAMAGE OR ANY OTHER PRODUCT LIABILITIES BASED UPON NEGLIGENCE OR STRICT LIABILITY. ANY ADDITIONAL OR DIFFERENT LIABILITIES ASSUMED BY NCI MUST BE CONTAINED IN A WRITING SIGNED BY AN AUTHORIZED EMPLOYEE
OF NCI.
Limitation of Liability
Niagara Cooler's liability to the customer or employees on any claim of any kind, including warranty or negligence, for any loss or damage arising out of, connected with, or resulting from the design, manufacture, sale, delivery, inspection, repair, operation or use of any heat exchanger covered hereby shall in no case exceed NCI's invoice price of the heat exchanger which gives rise to the claim.
In no event, whether as a result of breach of contract or warranty, alleged negligence or otherwise, shall NCI be liable for special or consequential damages including, but not limited to, loss of profits or revenue, loss of use
of the heat exchanger or other equipment, cost of capital, cost of substitute equipment, facilities or services, downtime costs or claims of customers for such damages.
Disclaimer for Plate Type Oil Coolers
Please note that a disclaimer is printed on our packing lists and billing invoices regarding the transmission or engine plate oil coolers that we supply. This disclaimer is to ensure that the end consumer is using the unit within our specified parameters. The transmission or engine plate oil coolers that Niagara Cooler Inc. supply are intended for use in systems that operate at 80 psi to 125 psi typical operating pressure. The oil coolers are leak tested at 300 psi and are statically burst tested to 1000 psi. Please ensure that the intended use of this cooler meets the above requirements. Niagara Cooler Inc. will NOT be responsible for any damage caused by failure of a cooler that is exposed to anything outside of these parameters.
